Conflict Of Interest Minister Who Says Kroll Report Is Lies




Nicholas Biwott used to be the cabinet Minister whose docket was energy and today he controls over 17% of the private oil industry in Kenya, according to the Kroll Associates reports. This in itself is more than a text book example of what conflict of interest is all about, long before you have gotten round to proving the other corruption allegations.

The idea of joining the hitherto low profile Energy Ministry may have no doubt been inspired by the stupendous amounts of money made from the Turkwell Gorge which gave the money launderers placed with the responsibility of transferring the funds overseas, a nightmare.

But apart from energy Biwott owns colossal interests in tourism, air transport, mining, real estate, telecommunications, construction and agriculture.

It is apparent that one of the main informants for the Kroll report was Alnoor Kassam of Trade Bank and Diners Finance fame. An astute entrepreneur who made the big mistake of trying to use Kenyan politics to his advantage, Kassam barely got away with his life.

What happened to him after he left Kenya is worth noting here. He almost went over the edge contemplating suicide several times but finally turned over a new leaf and rebuild his life. He is currently running for mayor of Calgary.

Back to the Kroll report. A section confirms what Kenyans were told at the Goldenberg commission by Kamlesh Pattni. That to see the president businessmen were asked to come with briefcases full of money which they then left behind at the end of the meeting.

The Kroll report says that this was considered as a fee to access the president.

Both Josiah Kiplagat and Joshua Kulei arranged between 7 and 8 meetings in which Kassam met Moi. As advised, he carried between 2 and 4 million in briefcases for each meeting which he left behind.

Kassam's often stormy business relationship with Biwott began with the Middle East Bank purchase saga. Kassam was at the time very seriously looking for a banking license. At the time Kassam was seeking to buy the bank he turned up at Prof George Saitoti's office and found Biwott already there with Akber Esmail. Esmail was then told to wait outside and Biwott asked him to abort his move for Middle East Bank so that he (and Esmail) could purchase it. Kassam agreed without resistance and shortly after that Esmail who was Biwott's nominee at the bank was appointed chairman.

Evidence suggests that most of Turkwell Gorge Hydro Electric project money (handled by Biwott and Moi) was laundered through this bank and on to foreign accounts. What made matters worse for the country was the fact that these were the days of foreign currency controls so meager foreign country resources at Central Bank were allocated to Moi and Biwott transferring huge sums of money abroad. Later Biwott transferred his operations to Trade Bank.

Biwott to Kassam after paying Kshs100 million in debt interest; "…don't do that again. If you do I will not be responsible for what happens to you."


Trade Bank which Alnoor Kassam acquired from Gad Zeevi an Israeli businessman (later deported by Biwott but now involved in business dealings with him again) had a huge loan in it's books taken out by Biwott and Gad Zeevi.

When the bank ran into problems Kassam felt that he should bring it to the attention of Biwott who summoned the Central Bank governor Eric Kotut and balmed it all on Zeevi saying that he had a habit of leaving debts all over the place. He asked Kotut to go easy on Trade Bank and also to help Kassam get the money owed through other means.

The issue was resolved over a 3-year period during which tax payers funds were credited to the bank directly from the Central Bank in Kenya shillings in the following order annually; 80 million, 180 million and 280 million.

The relationship between Yaya center, TradeBank and Biwott is complex. But when Tradeank took over Yaya center, Biwott insisted that his loan of 150 million be written off. This caused a lot of liquidity problems at TradeBank.

There was bribery in the acquisition of Yaya center to enable Trade Bank get the loan to acquire it. According to the Kroll report, Prof George Saitoti asked for a Kshs 4 million bribe.

The report goes on to tell the story of Solomon Muthamia who ended up with Kshs 100 million to his name when he was only 28 years old. Muthamia was the forex dealer at TradeBank and was entrusted with laundering the Turkwel Gorge funds on bahlf of Moi and Biwott. Biwott;s funds were channeled to accounts in Germany and the UK and Muthamia opened his own accounts in the same banks and then proceeded to skim off small amounts of the monies into his own accounts. Muthamia then went on to make further huge profits by providing local Asians with foreign currency cheques for a handsome commission when there was a huge shortage of dollars in the country.

Muthamia is believed to have launched Euro Bank from the proceeds of his illegal activities at TradeBank.

Alnoor Kassam pressed ahead with the deal to purchase TradeBank even when he was informed that Gad Zeevi owed the bank a staggering 400 million. He was desperate for a bank license then after seeing the kind of huge profits he was already making with Diner's Finance. Even after bribing Saitoti with Kshs 2 million in return for a banking license, according to the Kroll Associates report, Kassam still felt he needed a bank and was confident that he would later sort out the huge Zeevi loan issue.

Two years later Biwott and Zeevi reneged on the agreement they had had with Kassam to pay interest on the loan. Kassam was furious and approached Biwott who was in his office with Zeevi at the time. Receivers sent by Kassam were already at HZ construction. There was an almost violent confrontation between Zeevi and Kassam that forced Biwott to ask Zeevi to leave the room.

Biwott quietly asked Kassam to withdraw the receivers or risk losing TradeBank. Kassam stromed out of the office and Biwott called him back. Kassam insisted that Zeevi pays 100 million for him to withdraw the receivers. The money was paid by Biwott issued a chilly warming; "…don't do that again. If you do I will not be responsible for what happens to you."

Why The Kroll Report Will Never Be Discussed In Parliament

One of the saddest things about the leaked Kroll Associates report that sheds light on a lot of details of how corruption money was handled, laundered and transferred out of the country is that it is highly unlikely to be discussed in parliament.

The reason is simple, a casual look at the names mention in the report shows that the names cut across both members of the current opposition and the government.

Just imagine a situation where we are all thieves. How can any of us point a finger at the other? Doing so would simply provoke the accused to expose all the evils they know that are connected to their accuser.

I feel pity for many supporters of the ODM parties who are sure that their preferred presidential candidates are clean and have not been involved in any corruption. The Kroll report clearly shows how leaders of the past have looted public funds directly for their personal enrichment. The same people are still very powerful in society today meaning that members of the current government to survive in the Kenyan political system have had to do the same. The Kroll report shows clearly why the Anglo Leasing scum was inevitable.

So what do we voters do hen the entire political class is corrupt? Do we immerse ourselves in the election and campaign fever and forget what the people we are drumming up support have done in the past to their own country?

Any ideas out there?

P.S. By the way Jeff, when you say that there is nothing new about the Kroll report, I do not agree. Have you read through it? For the first time we are getting dates, places, specifics. There’s a lot of new information in this report. Just keep reading my daily digests of it here and you’ll see what I mean.

Strange Death Of Akasha Grandchild

Remember the famous Kenyan drug lord, Ibrahim Akasha? The guy who was assassinated by a guy in a bicycle who sprayed bullets into him and disappeared in the busy Amsterdam streets?

About a week ago a curious incident took place in his family residence in the plush Nyali estate in Mombasa. Kenyan police raided the Akasha home and searched the place thoroughly looking for evidence of drug trafficking. They found none. However in the confusion, the late Akasha's grand child (under 2 years old) crawled into the swimming pool and drowned without anybody noticing.

The Akasha family was very incensed and blamed the police for the death of the child. A family member was quoted as telling the press that these days the family is clean and deals in relief food to war torn areas and that is why the police found nothing in the Akasha home.

Interestingly one of the side businesses the late Akasha used to dabble in sometimes was gun running. Co-incidentally one of the businesses that arms dealers sometimes use as a cover is that of distributing relief food and supplies.

Direct Link Established Between Money Launderer And Mois

Focus on the Kroll Associates Report

To understand the following article, you will need to first understand what money laundering is. Read this Kumekucha article that explains what it is.

Investigators compiling the Kroll report were able to establish a clear link between one of the biggest money launders in Europe, based in Geneva, called Gabriel Moussa Katri nd the Mois. Brilliantly using his Kenyan clients, Katri is said to have been the main person behind the channeling of vast amounts of money looted from Nigeria by the then president Sani Abacha which was channeled through Kenya's Trans National Bank onto various offshore destinations.

The main contact at Trans National Bank was Ashok Gohil (who died in 2001) and was Kulei's right hand man. One of the things Gohil did to facilitate his illegal activities was to set up companies in Kenya where ODM Kenya's Mutula Kilonzo was the main director. This included companies like Ashar Limited and Chen.

Finance and especially the dizzying financial transactions that are the hallmark of money laundering, which is an illegal activity for criminals, can get a little boring. However the main questions Kenyans need to ask themselves are where these huge sums of money coming from Kenya and being transferred abroad by the Mois was coming from. It is estimated that Moi and his associates transferred at least double what Sani Abacha laundered through Kenya. That is US$400 million through Katri alone and his Trans national bank conduit. What business were the Mois involved that would have generated this amount of cash? Already investigators have established that Joshua Kulei's wealth can not be justified by any dividends that could have accrued from the myriad of companies he is said to have had a stake in. Leaving everybody with only one conclusion, that this was corrupt money and in many cases looted funds from tax payers' money.

Further there were very significant legal reasons to use banks rather than transfer the corrupt money directly abroad. For starters most of the Western countries where the funds were pouring into have laws designed to check money laundering. However Nostro accounts belonging to genuine banks are never questioned and this is what Katri used for his two big clients in this case, namely Sani Abacha and Daniel Moi.

Katri's genius for hiding corrupt money did not end there. He further used wealthy friends to hide the money by paying it out to their accounts, only for the same funds to be paid back through another account belonging to the same business associates.

Katri has gone undeground since 2001 when he lost his Financial intermediary license when the Swiss authorities strated investigating his money laundering activities through Kenya using Kulei.

Joshua Kulei: Humble Prison Warden Who Rose To Be A Multi Billionaire

A friend described a meeting with Joshua Kulei to me that left me dumbfounded.

The man has very limited formal education and when discussing projects like in this case a newspaper property, the man has problems understanding some basic English words that have something to do with industry but cannot be directly translated into Swahili or his Kalenjin vernacular.

Yet his street-smartness and survival instincts enabled him to be one of President Moi's longest serving aides. He is still very much an untouchable because his finances, as we have seen are so closely intertwined with those of the former president that you cannot prosecute him without prosecuting Moi.

Kulei has a brother called Terer Kulei who lives in New York and manages several properties which Kulei owns in the United States. The Kueli's have a reputation in New York of retaining very healthy bank accounts.

It is quite something that a lowly former prison warden has chosen to set up office in the Big Apple where even many wealthy Americans cannot afford to live. And his wealth is growing because he has retained some of the best stock brokers in the world to trade in shares for him both in New York and London.

Terer who is younger than Kulei visits Kenya only briefly and spends most of his time in New York with his family. When he visits Kenya he is usually seen in Kulei's offices in Trans National Bank.

So where did the initial vast sums of money to invest in New York come from?

His pension from the Kenya Prisons pension fund perhaps? I say this because so cocky are these thieves of public funds that when interviewed they deny everything without giving any solid basis fro their denial. They even have the audacity to sue those who dare say anything. Already Gideon Moi has said that he is considering suing the Guardian in London who did an article based on the Kroll report. Maybe the Gurdian legal team should start their defense by demanding that the court ask the complainant how he is able to afford to take legal action in Britain. This would be firm basis of proving that whatever there is in the Kroll report and whatever was published in the Guardian is true and only a tip of the iceberg.

Why A Vote For Kibaki Is A Vote For Corruption

There are many good things which President Kibaki's many supporters point to as achievements of the president and I do not intend to argue or debate about those achievements.

The only thing that really worries me and should worry any Kenyan who loves his country more than his tribe is the corruption. The president has done nothing to act against looters in the past regime let alone those in his own administration.

The result is that even as you read this, crime in Kenya pays because many who attempted to get rich through genuine business have been frustrated every inch of the way while the corrupt ones have had very smooth sailing.

So why should our war against crime be justified? After all we have seen from the Kroll report that these looters are fond of threatening others with violence. Meaning that when you really think about it, there is no difference between the two different type of thugs, only that one is protected by the government while the other is shot on sight without the benefit of a trial. So which of the two thugs is more damaging to the country?

It is therefore very clear to me that a vote for Kibaki is not only a vote for the status quo, but it is also a vote for corruption. If this government is clean as many hapless Kenyans insist, where then is John Githongo? Why does he still fear for his life? Is the former ethics PS just imagining things? Why has no action been taken to date on his findings? How come the people he mentioned are back in government and giving Kenyans that arrogant what-can-you-do-about-it look?

The simple question voters need to ask themselves is this; How much longer can Kenya survive the looting and plundering of her resources by a few individuals?

And as has often been said here before by the likes of Taabu and others, it is individuals who have done the looting and not communities. How many Kalenjins are living with Kulei's brother in New York? How many Kalenjins have benefited directly from the looted wealth of the Moi's? How many Kikuyus have seen even one shilling of Anglo-Leasing money?

What Raila's Choice Of Mudavadi As Running Mate Says

It is increasingly clear that Western province will be a major battleground for the presidency and also parliamentary seats between the major political parties, in the forthcoming mother of all general elections.

On accepting the ODM presidential nomination, Raila Odinga immediately chose Musalia Mudavadi as his running mate, meaning that chances are high that the former VP will end up as Raila's VP should he be elected.

It is no accident that President Kibaki chose the late Wamalwa Kijana as his vice president in the elaborate power sharing structure that was set up prior to the 2002 general elections. The advantage President Kibaki had then was the fact that the Bukusus have a very large voting bloc, probably the largest amongst the entire Luhya community. And they are also very influential.

Not only that, the Bukusu had full confidence in Wamalwa Kijana the sort of confidence they do not have in current Ford Kenya leader Musikari Kombo.

Musalia will now have to do battle for the people's hearts with Cyrus Jirongo of Kaddu who has been at the forfront of campaigning for Luhya unity. There are many who are sure that this is one battle that Musalia will lose badly, more so because the Bukusu will definitely not support him and ODM. This sect within the Luhya community may not have full confidence in their Musikari Kombo but their politics is that they would rather vote for an outsider than an enemy of their chairman.

By the way, my prediction about President Kibaki getting his next VP from Rift Valley seems to be shaping up already. In today's newspapers, Rift Valley politicians are demanding the VP slot in exchange for their supporting President Kibaki's re-election bid. Still it is too early to make any predictions, especially because there are those who insist that the Kalenjins and the main campaigner amongst them for Kibaki, Daniel Moi needs the current government more than they need him.

Top 100 Wealthiest Kenyans Are All Crooks

Today we start a series of articles focusing on the controversial Kroll Associates report leaked on the Web. It makes for some fascinating reading and I feel that it is appropriate that we digest the contents here so that as many Kenyans as possible understand the issues involved here.

We will digest the report on a daily basis until we have gone through the entire thick document. So do not forget to read today's posts.

Meanwhile it is worth noting that the top 100 list of the wealthiest people in Kenya is made up of only crooks or the children of such corrupt persons who used their positions to accumulate wealth. It is now widely believed that the wealthiest Kenyans are the Moi's, Daniel and his favorite son Gideon in that order.

The Kenyatta family also features somewhere in the top ten and most of their wealth is in land as well as the standard 15 per cent ownership that the family took in many major foreign investors coming into the country during the Kenyatta era. This was mostly made up of hotels but also included other types of businesses like industries, banks and so on.

Apart from the prominent families, the rest of the names in Kenya's top list of the wealthiest in the land consist of cronies and sidekicks of the major players.

How can we fight crime and even violent crime in the country when it is clear that so far crime pays in Kenya. Just think about that one, long and hard.

Is it a coincidence that whenever we approach the general elections, the number of road accidents (most of them freak accidents) increases dramatically and with it also deaths of numerous Kenyans?

Most educated and sophisticated Kenyans will tell you that this is a mere coincidence. However those who have visited witch doctors will tell you that these guys who are terribly busy countrywide, just now require "human blood" to cement their more powerful spells.

They will also tell you that to obtain this human flesh, a person will either be asked to sacrifice a close relative or family member. This is usually not a problem because many aspirants want to win at all costs and are prepared to pay any price to see the inside of parliament. Alternatively "traps" will usually be set on roads so that freak accidents can happen that will spill as much human blood as possible.

President Sam Nujoma of Namibia: Close family friend of Moi and personally "protects" the assets of the Moi family which has increasingly been invested in that country for safekeeping away from "political interference" or scrutiny by the world.


One of the most shocking things that the Kroll Associates report uncovered is a company called Government Of Kenya. The legal implications here are colossal. It means that the owners of the said company can trade using that name. It also means that cheques made out to the government of Kenya can easily be cashed by the said private company.

According to the Kroll report, the directors of the company called Government of Kenya are former President Moi, Nicholas Biwott, George Saitoti, Sally Kosgei, J. K. Musyimi, Mark Bor and a Mr Deche.

It seems that sometimes in November 2003 there was a meeting at ex-president Moi's Kabarak home which was attended by his sons Philip and Gideon, as well as long serving aide Joshua Kulei. Also in attendance was trusted family lawyer, Dr Kiplagat. The main agenda of the meeting was to explore how best to protect the vast family wealth, both locally and broad from any possible political interference.

If you remember, already by this time there had been threats to have former president Moi write a statement to assist in corruption investigations which was very strongly resisted by MPs from Rift Valley. One of the individuals who strongly defended the former president and urged his colleagues to leave him alone was one Raila Amollo Odinga. This is a documented fact.

Anyway back to the meeting in Kabarak in November 2003. The family lawyer advised the Moi's to keep as much of their wealth and assets as they possibly could overseas. The lawyer pointed out that legally no court order or ruling had been issued declaring the Moi wealth as having been acquired through corrupt or illegal means, which would be required by the government to freeze those assets and bank accounts abroad. They were also advised to use trusts that were experienced in hiding controversial assets on behalf of high profile clients.

However the meeting did not end well. It emerged that Joshua Kulei's own estimates of the amount he held in trust for the Moi family and which he was now required to surrender and estimates of the same by Moi's sons did not tally. The tension got so high that death threats are believed to have been issued against Kulei.

Matters got worse at a meeting later held at Philip's house to try and resolve the misunderstanding over the issue and Kulei made the unfortunate decision to go outside the Moi family to seek for help. It is highly likely that this is the move that caused details of the meeting to leak to those who were not involved. Kulei consulted Mr Tum of the Kenya Seed Company to talk to the former president on his behalf. He told Tum that the crux of the problem was that the president's sons had failed to make any distinction between his (Kulei's) private wealth and that held by the president in trust.

It is unlikely that such a matter will ever end up in court, but even if it was, it is clear that Kulei who was a poverty stricken prisons warder by the time he was appointed to handle the Moi wealth did not have any personal wealth of his own apart from what he was looking after on behalf of his benefactor. Any monies he would have earned for himself during that time would have either involved the use of the same funds he was supposed to look after or at least by virtue of his position. This means that the Moi's sons had a point and all the money belonged to the Moi's since he was paid to do the job.

Incidentally after the Kabarak meeting, there was heightened activity in relation to the family assets in what appears to be a well co-ordinated move to secure the family wealth, which many believe is made of tax payers money and looted assets.

A significant chunk of the Moi assets and fortune in general is now in Namibia where it is under the protection of the former president's good friend and president of that country Sam Nujoma. It is believed that Gideon Moi may transfer (if he has not dome so already) a lot of the family wealth from South Africa to Namibia where the family feel more comfortable and secure to keep their treasure chest.

Strange Discussion That Proves Some Kibaki Supporters Are Tribalists

I had an interesting discussion with a relative today, who was trying to update me on the general mood prevailing in the country at the moment. He mention a recent friendly debate with supporters of President Kibaki that left a sour taste in his mouth.

The friends launched into the usual reasons why they are supporting the president's re-election bid. CDF money that has developed many constituencies countrywide and the fact that things are working better now than in the days of President Moi.

They were asked if they had personally benefited from any of this "massive development countrywide" and they said, not really, but people in the rural areas could easily testify to it.

But it was what they said next that was a shocker.

One of them remarked; "So I assume that you are supporting Kalonzo Musyoka."

"Why?" my relative asked.

"Si nu Mtu wenyu!" (does he not belong to your community.).

This statement confirmed beyond any reasonable doubt the his friends were supporting the incumbent simply because "ni mtu wao." (comes from their community.).

The really sad thing here is that these were supposed to be enlightened city-types. So you can imagine what is happening in the rural areas.

By the way, readers should pay more attention to the views of the mysterious Jeff. In my opinion he is spot on in insisting that the only way to get the change we want is to have a generational change in our leadership.

According to a report that a Hala Gorani and Jeff Koinange filed for CNN, the Nigerian movie industry, popularly referred to as Nollywood is currently churning out 200 home videos daily which firmly outs it at number 3 after Bollywood (India), and Hollywood (USA).

Impeccable sources have informed me that the leaked Kroll Associates report is just a tip of the iceberg so to speak.

2007 Mother Of All General Elections In Kenya: Wrong Time For Predictions

Yes, I am aware that the ODM presidential nominations were completed yesterday, however a word of advice.

This is not the time to start making sweeping predictions on who the next president of Kenya will be. In case you haven’t noticed, things are extremely fluid just now. If you are one of those people fond of showing off your prediction-making skills, I would advice that you wait until the beginning of November at the very earliest to start making any predictions.

Mr Biwott Sir, Kroll Report Is Nonsense, So How Did You Make Your Money?

Money is a strange thing. When you have too much of it acquired too quickly through dubious means, it gives you a false self confidence and feeling of invincibility. Chances are that you will start making statements that don’t make any sense.

Keiyo South legislator Nicholas Biwott has dismissed the Kroll report and has gone further to deny any connection to the companies mentioned in the report. He says that he does not even have money abroad.

That’s fine sir. But can you tell Kenyans how you acquired your immense wealth so quickly? Is it a coincidence that you had to wait for Jomo Knyatta to die to start making money like there was no tomorrow. How come your business acumen was not visible during the Keyatta years?

It is rapidly becoming very clear that the political situation in Kenya is just too fluid. Just a few days ago it looked like former president Moi had given President Kibaki a “hrough pass”for re-election. Now it is clear that Moi is excess buggage to the Kibaki re-election bid.

Details in the Kroll Associates report (which I will be analyzing in this blog over the next few days) are very damaging to Baba Gidi, Gidi and many of their cronies. It has attracted international attention and suddenly put Moi on par with disgraced names like Sani Abacha and Mobutu Sese Seko. President’s Kibaki’s handlers must surely know that they have to distance themselves from the former president pronto or else they could suddenly find that the president’s re-election plans are still-born before he even launches his campaigns proper.

Otieno Kajwang’s New Career Unveiled At Kasarani

The current MP for Mbita Otieno Kajwang is in trouble, so his constituents tell me. They tell me that it will be much easier for the notorious reeds on the lake to disappear overnight than for Mheshimiwa Kajwang to see the inside of the 10th Parliament.

ODM Presidential Nomination: The Past Comes Back To Haunt Those Who Voted In 2002

The defining image for me from the 2002 general elections was the swearing in of President Kibaki when a Nairobi man voluntarily took a dip in the murky waters of Uhuru Park, drinking some of the water in the process. He didn't care, he was ecstatic that change had come over Kenya with the felling of Kanu and the win of the National Rainbow Coalition and Mwai Kibaki. I often remember that man and wonder what became of him. More so because somebody trashed his dream (and our dream) into those same murky waters of Uhuru Park.

I mention this because I saw a similar spirit at Kasarani today during the ODM presidential nominations. Enthusiastic Kenyans, enthusiastic and extremely hopeful that the change they were cheated out of in 2002, will happen this time. I couldn't help feeling pity for them because there are still too many obstacles to real change in Kenya.

A leopard cannot change its' spots and I see the same looters and "rapists" of the Kenyan economy and Kenyan people hanging around Raila and Odm and waiting in anticipation for him to win the presidency so that they can continue to do what they have been doing all along.

Presidential hopefuls, Raila Odinga were blocked and then slowly escorted into Kasarani by enthusiastic, chanting crowds. The crowds shouted; "Ruto, Dawa Ya Moi." (meaning Ruto the "strategy" against Moi.).

By the time I posted this, the high point of the special delegates conference at Kasarani to elect the party presidential flag bearer was the dramatic stepping down of Najib "Nina Jibu" Balala in favor of Raila Odinga. That left only four candidates, namely Raila Odinga, William Ruto, Musalia Mudavadi and Joseph Nyagah.

Raila claims that the move took him totally by surprise and Kenyans saw a side of the ODM hopeful that they had never seen before. Raila visibly shed tears and openly wiped them off with a white handkerchief.

The facts are that Balala has a lot to be grateful to Raila for.For instance, impeccable sources inform me that a large number of voters supporting Raila in Coast province have shifted constituencies to Mvita where Balala should win re-election easily despite the big names plotting to oust him from the seat. Stepping down for Raila has therefore been a move than many keen political observers have anticipated for a long time.

Generational Change Comment By Joe Nyagah

ODM presidential hopeful Joe Nyagah told delegates today that the two provinces that have remained behind are Central and Eastern. The reason is that those two provinces have NOT had a generational change like the rest of Kenya and are still being led by old people who according to Nyagah have no idea what a computer is.

Nyagah asked the rest of the provinces to pray for the two provinces being left behind by the rest of Kenya.

Indeed it seems that the generational issue is shaping up to be a major campaign issue. Raila Odinga told the delegates that these elections will be between two distinct camps; namely those who want to maintain the status quo and those who want change. Because you cannot teach an old dog new tricks, it is unlikely that that change will be brought about by the older generation.

Moi's Grand Theft Ignored, For Now

The Daily Nation, today nervously carried a headline detailing the revelations of the leaked Kroll Associates report about the billions that former President Moi is said to have accumulated illegally. The story was carried on the front page although jittery (with good reason) editors watered it down somewhat by implying in the headline that the "looting" had been carried out by only by Moi henchmen and not Moi himself.

Moi has has often rushed to lawyers for refuge through threats to sue and there is no doubt that he must have taken legal advice on the recent developments. However it will be a bit difficult this time because the report has been widely quoted in dozens of newspapers around the world. The image of the retired president is taking a dramatic nosedive from what he has long wanted it to be—that of an elderly statesman. Now it is emerging that the former president can be placed on the same level and given the same image as other major looters in Africa from the past like Sani Abacha of Nigeria and former President of Congo, Mobutu Sese Seko (and remember that Kenya is nowhere near being as mineral-rich as either of those countries and especially that troubled Central African country formerly called Zaire, where Mobutu pocketed billions from public coffers banking most of it in secret Swiss accounts).

In the excitement of the ODM presidential race, Moi can be grateful that this big news that portrays him in very poor light, has been shoved to the periphery—at least for now.

Kroll Report And Looted Moi Billions Puts Moi On Mobutu Sese Seko Level?

Daniel arap Moi and Mobutu Sese Seko on the same level?
This is what citizen journalism is all about. Earlier today somebody left links in this blog about a leaked report by a leading international private investigations organization called Kroll.

By the time I got to the wiki page, somebody had deleted it. That person does not understand the way the web functions and this was an exercise in futility. I am sure another copy will turn up on the web very soon.

The report and extracts copied from it are shocking to say the least.

Investigators compiling the Kroll report were able to establish a clear link between one of the biggest money launders in Europe, based in Geneva, called Gabriel Moussa Katri nd the Mois. Brilliantly using his Kenyan clients, Katri is said to have been the main person behind the channeling of vast amounts of money looted from Nigeria by the then president Sani Abacha which was channeled through Kenya's Trans National Bank onto various offshore destinations.

The main contact at Trans National Bank was Ashok Gohil (who died in 2001) and was Kulei's right hand man. One of the things Gohil did to facilitate his illegal activities was to set up companies in Kenya where ODM Kenya's Mutula Kilonzo was the main director. This included companies like Ashar Limited and Chen.

Finance and especially the dizzying financial transactions that are the hallmark of money laundering, which is an illegal activity for criminals, can get a little boring. However the main questions Kenyans need to ask themselves are where these huge sums of money coming from Kenya and being transferred abroad by the Mois was coming from. It is estimated that Moi and his associates transferred at least double what Sani Abacha laundered through Kenya. That is US$400 million through Katri alone and his Trans national bank conduit. What business were the Mois involved that would have generated this amount of cash? Already investigators have established that Joshua Kulei's wealth can not be justified by any dividends that could have accrued from the myriad of companies he is said to have had a stake in. Leaving everybody with only one conclusion, that this was corrupt money and in many cases looted funds from tax payers' money.

Further there were very significant legal reasons to use banks rather than transfer the corrupt money directly abroad. For starters most of the Western countries where the funds were pouring into have laws designed to check money laundering. However Nostro accounts belonging to genuine banks are never questioned and this is what Katri used for his two big clients in this case, namely Sani Abacha and Daniel Moi.

Katri's genius for hiding corrupt money did not end there. He further used wealthy friends to hide the money by paying it out to their accounts, only for the same funds to be paid back through another account belonging to the same business associates.

Katri has gone underground since 2001 when he lost his Financial intermediary license when the Swiss authorities started investigating his money laundering activities through Kenya using Kulei.

The mother of all general elections is now less than 4 months away and things are getting HOT.

There have been all sorts of rumours circulating including one ridiculous one that Raila will step down for Musalia. I asked our ODM specialist Phil and his reply which some of you may have missed almost made me fall off my chair. Read it for yourself below;

You are right, that rumour is very true, but in my opinion such an action is premature.

And again, only Raila himself will decide whether to drop his candidature or not. Besides, his commitment is so deep that we know he is running at least three fully fledged campaign secretariats and he has his own personal council of professional advisors.

Though everyone, including Raila, is in agreement that an ODM win overrides all other interests, because no one wants another stint in opposition benches!

I think it would be suicidal to name Mudavadi on Saturday and make him an obvious target for Kibaki and company. (Remember they have all the Goldenberg, NBK and KCB files).....Mudavadi as a politician, a business person and family man cannot fight the government machinery on his own.

Another rumour is that ODM aspirants could all drop their bids at the last minute for another Kikuyu candidate. He may be voted in through the Dagoretti constituency seat. He will appeal to the youth, other tribes as well as donors. His name is John Githongo. And in his first public speech as an ODM candidate, he will unleash the mother of all bombshells - a recorded discussion with the Head of State urging him 'to look the other way'.... Moi,Kibaki Tena crowd or even Derek here will not have an answer to that tsunami.

Am told that Uhuru Kenyatta is having some serious soul searching about recent political developments and is weighing implications of throwing his weight with the ODM, and to a lesser extent ODM-K lot. He may even make an appearance at Kasarani today or tomorrow.

Yes, Chris, I'd say it is a possibility for Raila to drop a bombshell, but not so soon, probably towards end October, early November when the picture will be much clearer....right now it is still a little fuzzy. Let Kibaki declare his party of choice and launch his vision, then you will see fire works.

Remember NO ONE, including our famed NSIS saw the recapture of original ODM party from Lawyer Mugambi Imanyara...could he have been Raila's long term strategic plan?

ODM-Kenya: What Impact Will Its' Presidential Candidate Now Have?

Stephen Kalonzo Musyoka this afternoon beat his only challenger Prof Julia Ojiambo by garnering 2,835 votes against 791 votes to become the ODM-Kenya presidential candidate. The action was at Kasarani Stadium (some have christened it Kiserani—meaning controversy).

Tomorrow the other Orange party, ODM original, will hold a similar exercise at the same venue to come up with their presidential candidate. They will have a tough act to follow because the ODM-Kenya elections were extremely well organized.

It is expected that Mr Musyoka will seek an alliance with another political party before facing the general elections and he has said so himself several times. It is highly expected that that alliance will either be with the other ODM party, Kanu or even Narc Kenya. The last two choices are more or less the same thing because we now know that Kanu will be working very closely with Narc Kenya and will be supporting Mwai Kibaki's re-election bid.

His wife in a stunning outfit that had lots of orange, the ODM-Kenya color, accompanied Musyoka. This is a very important plus for Musyoka which Kenyans should learn to appreciate. This presidential candidate has one wife and it is sad that most Kenyans have failed to see the link between broken and polygamous families and the rising rate of crime in the country. There is a clear, established link (that is a story for another day) and the person I vote for as president will NOT be a bad example to my son and grand child. I don't want more questions from my grandson that I cannot answer.

There was a very strange, almost fake, atmosphere in this presidential nomination process. Like everybody already knew what the results were going to be. There was no sense of competition and neither of the candidates attempted to make a last minute appeal for votes from the delegates.

More interestingly the whole exercise cost well over a whopping Kshs 20 million. Which leads us to the 20 million shilling question: who financed it? Although ODM-K has a few millionaires, none of them are capable of putting up that kind of money alone. So was it a team effort?

P.S. There were too many people at Kasarani talking in Kikamba accents and wearing the tell-tale Kamba colours. Many of them were even involved in the organization of the delegates conference and presidential elections. Hon. Kalonzo Musyoka is one of the people who has criticized the president for his appointments claiming that they tend to lean too much in the direction of one community. He should therefore set an example and show Kenyans signs of his government to come by reducing the Kamba accents operating close to him and the party office bearers. Even the chairman should NOT be a MKamba.

2007 General Elections Will Be Held Before Christmas

Several quarters have confirmed that the President has said that he would like Kenyans to enjoy their Christmas holidays this year without any approaching elections over their heads. In other words, he is looking for an election date before Christmas.

Analysts believe that it would have to be shortly after Jamuhuri day (independence day) which falls on December 12th. This makes our countdown a little complicated, (does it not, Bwana Luke?)

Since 1992 and the re-introduction of multi-party politics, the general elections have traditionally been held shortly after Christmas and before the New Year. Incidentally this kind of arrangement allows for maximum participation as most Kenyans are in their rural homes at that time. However holding the elections shortly before Christmas will serve the same purpose because most Kenyans will then take an early holiday to be in their rural homes to vote just before the most widely anticipated holiday in the Kenyan calendar.

MPs have recently expressed fear that the manner in which the government is rushing forward house business in parliament suggests that the president is about to dissolve the house in preparation for the general elections.

The president's rigorous campaign schedule at Mombasa over the last few days that has involved a lot of walking and shaking of hands (two things the president hardly does) would also add credence to the theory of an earlier than expected general election.

However realistically speaking, the earliest the elections can be called for is late November. Folks did you realize that we are already in September (in a few hours time). How this year has flown by!!

Carjackings have Ended In Nairobi—Mutua

In his weekly press briefing this morning, government spin-doctor, Alfred Mutua said that carjackings were now a thing of the past in Nairobi and no longer exist. What???

While it is true that they have greatly reduced, making such a sweeping statement is surely premature and highly misleading from a government spokes person. More so when we all know that many other types of violent crime (hardly reported in the mainstream media, and we know why) continue just as before.

This is a cheap campaign gimmick.

Another gem from Mr Mutua was when he said at the same briefing that his research has shown that the most favored tribe in government appointments in president Kibaki's administration are the Luhya community.

Oh please sir, don't abuse the intelligence of Kenyans.

What Is The Police Commissioner Doing In Osaka

Is the police commissioner recruiting speedy would-be officers for the police force in Osaka? Or what is the Maj General Hussein Ali doing with the Kenyan athletes currently in that Japanese city?

Sports Minister Maina Kamanda is with the team in Osaka and was seen on TVs all over the world enthusiastically hugging that young supu who won the 800 metres, gold medal in the ladies event. However at another function where the Minister was addressing/giving a pep talk to the team, the police commissioner was seen seated and listening attentively.

Major General Ali is well known for frequently "not giving dignity to questions by answering them" where he feels that they are not intelligent enough or relevant questions. I have a feeling that a question like "what are you doing in Osaka," would fall under this category.
