The high court will today (11th August) give direction in a most fascinating, unprecedented case where one of the big ethnic communities in the country seeks secession.
More than 10,000 Luos have filed a petition with the High Court requesting permission to establish their own independent state and self-government.Ogillo Jijo Mark Pascal is requesting that the state be compelled to hold a referendum so that the Luos can establish their own state.
Ojijo, a presidential contender who describes himself as Luo by ethnicity, claims that secession is not illegal in Kenya and that it is time for Luos to forge their own path as a people committed to change.
He claims that during demonstrations, the State regularly and repeatedly used excessive force on the Luos.
Ojijo also claims that Luos have been unfairly disadvantaged in the distribution of resources.
"The state has limited my ability to exercise my constitutional right to political, social, cultural, and economic development. Additionally, the State has utilized the law and the media to portray Luos as violent, evil, and opposed to progress, the man claimed.
"Ethnic profiling, discrimination, lack of development, and harassment shall continue and these shall prejudice, harm, and limit his right to self-determination," according to the statement.
In his court documents, Ojijio requests that a ruling be made prohibiting the state from preventing him from engaging in self-determination activities.
He claimed that the Luos had the right to establish liberation movements since it is fundamental to the right of people to self-determination.
